Terms of Service
1. OVERVIEW
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Aenku Coffee (“Aenku”, “we”, “us”, “our”), governing your access to and use of the Aenku platform, including the AENKU Wellness Engine (the “Service”).
Aenku operates an AI-powered health–coffee intelligence platform that provides algorithmically generated insights, personalized recommendations, and wellness-oriented coffee guidance. This Service utilizes a proprietary multidomain intelligence core to analyze user-provided inputs, biological markers, and behavioral signals.
By accessing or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms.
2. DESCRIPTION OF SERVICE & AI SYSTEMS
2.1 Personalized Coffee Intelligence
Aenku provides AI-driven tools designed to analyze complex lifestyle and biological inputs, including:
•Caffeine Metabolism Modeling: Inferred genetic phenotypes (e.g., CYP1A2 enzyme activity) based on behavioral proxies.
•Pharmacokinetic Curves: 12-hour plasma concentration modeling of caffeine levels.
•Wellness Domain Scoring: Analysis across 12 distinct domains including sleep quality, stress response, energy patterns, and cognitive focus.
•Product Matching: Algorithmic pairing with specific coffee products based on sensory profiles and wellness goals.
2.2 Wearable Integration
If you choose to connect a wearable device (e.g., via the Aenku Wearable API), the Service will process biometric data including Heart Rate Variability (HRV), sleep stages, and activity levels to refine your wellness profile.
2.3 Automated Decision-Making
Recommendations are generated by automated machine learning models. These models evolve through continuous training on aggregated, anonymized data to improve accuracy and personalization.
3. DATA HANDLING & PRIVACY (GDPR COMPLIANCE)
3.1 Data Collection & Consent
By using the Service, you explicitly consent to the collection and processing of health-adjacent data. This includes quiz responses, inferred biological traits, and biometric data from wearables.
3.2 Data Retention Policy
Aenku adheres to a strict data retention schedule to balance longitudinal wellness value with user privacy:
•Quiz Submissions & Wellness Profiles: Retained for 3 years to allow for historical comparison.
•Wearable/Biometric Data: Retained for 18 months to capture seasonal patterns while minimizing long-term storage of sensitive data.
•Audit Logs: Retained for 90 days for security and incident investigation.
•Financial Records: Retained for 7 years as required by tax and audit regulations.
3.3 Right to Erasure
You have the “Right to be Forgotten.” You may request the permanent deletion of all your personal and wellness data at any time by contacting privacy@aenku.com.
4. MEDICAL DISCLAIMER & LIMITATIONS
4.1 Not Medical Advice
The Service is a wellness guidance tool, NOT a medical device. All outputs, including pharmacokinetic curves and genetic phenotype inferences, are probabilistic models based on self-reported data and population-level research.
•No Diagnosis: Aenku does not diagnose, treat, or prevent any medical condition.
•Consult Professionals: Always consult a qualified healthcare provider before making changes to your diet, caffeine intake, or health regimen.
4.2 Inherent AI Probabilism
AI outputs may contain inaccuracies. Recommendations reflect the statistical likelihood of a “best fit” and should not be treated as clinical certainty.
5. INTELLECTUAL PROPERTY & PROHIBITED USES
5.1 Proprietary Logic
All proprietary algorithms, including the CYP1A2 Engine, Multidomain Intelligence Core, and Scoring Models, are the exclusive intellectual property of Aenku.
5.2 Prohibited Actions
You are strictly prohibited from:
•Attempting to reverse engineer, decompile, or extract the weights of Aenku’s machine learning models.
•Automated scraping of the Aenku product catalog or supplier database.
•Misrepresenting AI-generated wellness insights as professional medical evaluations.
6. FEES & SUBSCRIPTIONS
Certain premium features, including longitudinal dashboard access and advanced AI narratives, require a paid subscription. Payments are processed via third-party providers (e.g., Lemon Squeezy). Subscriptions auto-renew unless cancelled.
7. GOVERNING LAW & DISPUTES
These Terms shall be governed by the laws of Ethiopia. Any disputes arising from these Terms or the use of the Service shall be resolved through individual arbitration, and you waive any right to participate in a class-action lawsuit.
